There are a number of different types of conduct that may be construed to be misleading or deceptive conduct.
Misleading Statements
A person who makes a misleading statement can be found to be in breach of Section 18 of Australian Consumer Law.
Statements About the Future
If a statement projects or forecasts the future it can be deemed misleading or deceptive. Statements about the future are not misleading simply because they turn out to be false – the ruling factor will be whether or not the party making the statement had reasonable grounds for making a statement predicting the future and whether the party making the statement knew the statement was untrue or correct.
Silence as Misleading or Deceptive Conduct
Misleading or deceptive conduct can also consist of omissions or silence in relation to relevant information. For example:
one person fails to alert another to facts known only to them, and the facts are relevant to a decision;
important details a person should know are not conveyed to them;
a change in circumstance meant information already provided was incorrect.

Ben is a dedicated lawyer in the team at Vogt Legal, known for his commitment to integrity, fostering client relationships, and maintaining a strong work ethic. Ben has valuable experience across a range of legal areas.
Malcolm is an experienced practitioner with a robust legal background. He began his legal career in South Africa as an articled clerk in 2015 and was admitted as an attorney of the High Court of South Africa in 2017. Malcolm advanced to become a director at Tatham Wilkes, one of South Africa's oldest law practices, where he managed a busy civil litigation practice, focussing on insurance litigation and family law.
In February 2021, Matthew was admitted as a lawyer of the Supreme Court of Western Australia. Matthew’s main legal interests lie in contract law, dispute resolution, employment law, and trial work.
Terrence graduated from the University of Western Australia with a Juris Doctor in 2017 and has spent most of his career working in family law and estate planning.
Mark is a Lawyer at Vogt Legal, having joined the firm in January 2025. Mark holds a double degree in Law and Arts from the University of Notre Dame Australia. Currently practising as a paralegal with Vogt Legal, under the supervision of Will Vogt, Joe intends to requalify as an Australian lawyer.
Joe has a keen interest in meeting clients’ litigation needs efficiently and effectively, and developing long-term client relationships based on trust and reliability.
Based permanently in South Africa, Joe is a member of Vogt Legal’s remote team.

Paralegal
Ellie was admitted as a lawyer of the Supreme Court of New South Wales in August 2025 and joined our firm in December 2025. She holds a Juris Doctor degree from the University of New South Wales and also holds a P.R. China Legal Profession Qualification.
As a paralegal, Ellie assists the team in litigation and dispute resolution, with a particular focus on building and construction disputes. Prior to joining the firm, she spent five years working as an in-house legal counsel for a Singapore-based NASDAQ-listed technology group.
With bilingual proficiency, Ellie also provides legal services in Mandarin.
